The Central Board of Indirect Taxes and Customs (CBIC) has issued a fresh set of Standard Operating Procedures (SOPs) for conducting GST investigations, aimed at ensuring consistency, fairness, and transparency across enforcement activities. These SOPs are designed to regulate the conduct of officers during searches, summons, inspections, and information collection, ensuring that the rights of taxpayers are respected and protected during the process. The guidelines are also aligned with recent judicial pronouncements emphasizing procedural safeguards in tax administration.

According to the new SOPs, all investigations must be based on credible intelligence or data-driven alerts, and officers must maintain a formal record of approval before initiating any action. During investigations, officers are instructed to issue clear notices, avoid coercion, and give reasonable time to taxpayers to respond. Statements recorded must be voluntary, and the use of physical or psychological pressure is strictly prohibited. Moreover, taxpayers are now entitled to legal representation and access to documents used during the investigation, reinforcing the principles of natural justice.The CBIC also mandates that investigations must be concluded within a reasonable time frame, and any further inquiry must be communicated in writing. Detailed post-investigation reports are required to be submitted, and regular internal audits will be conducted to ensure compliance with the SOPs. These measures are expected to build trust between tax authorities and taxpayers, improve the quality of investigations, and minimize unnecessary litigation by ensuring due process and lawful conduct throughout GST enforcement.
