1. Automatic Formation by Family Structure
• A Hindu Undivided Family (HUF) is created automatically when a Hindu family (including Buddhists, Jains, and Sikhs) lives together under a common ancestor.
• No formal registration is required for its existence.
2. Requirement of Joint Family Property
• The HUF must have some ancestral or jointly acquired property.
• Even a single male member can form an HUF if he holds ancestral assets.
3. Initiation by a Karta (Head of HUF)
• The eldest male member usually acts as the Karta (manager).
• A female can also be a Karta under certain legal conditions (court rulings).
4. Declaration & PAN Card Registration
• For legal and tax purposes, the HUF must obtain a separate PAN card.
• A declaration deed (optional but recommended) can be made to formalize its existence.
5. Addition of Members Over Time
• New members (sons, daughters, wives) are added by birth or marriage.
• The HUF continues as long as there are at least two members (e.g., father & son).
