Special Grievance Cell Launched for Section 8 Complaints
In a landmark step toward safeguarding transparency and ethical operations in the non-profit sector, the Ministry of Corporate Affairs (MCA) has launched a dedicated Special Grievance Cell to address complaints against Section 8 companies. This newly established mechanism aims to streamline the redressal of grievances related to misuse of funds, governance lapses, and non-compliance with statutory obligations under the Companies Act, 2013.
The Special Grievance Cell will function under the direct supervision of the Registrar of Companies (RoC) and will serve as a single-window platform for stakeholders, whistleblowers, and the public to report irregularities in the functioning of Section 8 entities. Complaints can be submitted through the MCA21 portal, with an option for confidential submissions and anonymous reporting in sensitive cases.
According to officials, this initiative is part of the government’s broader strategy to instill greater accountability among non-profit entities enjoying tax exemptions and CSR partnerships. The cell will assess the merits of each complaint, initiate preliminary inquiries, and where necessary, escalate cases to investigative or regulatory authorities. Entities found guilty of violations may face penalties, license suspension, or prosecution.
To ensure efficiency and responsiveness, the cell will follow strict timelines for addressing grievances and has been equipped with digital tools to track, analyze, and prioritize complaints. The MCA has also urged directors and compliance officers of Section 8 companies to cooperate fully with the grievance process and maintain transparent operational records.
Experts believe this move will not only deter malpractice but also encourage good governance and protect the interests of genuine charitable organizations. By empowering citizens and stakeholders to voice concerns, the Special Grievance Cell marks a significant leap toward fostering trust, transparency, and ethical conduct in India’s non-profit ecosystem.
