The government has introduced a new standardized format for partition agreements within Hindu Undivided Families (HUFs), aiming to simplify the process of division and ensure legal clarity in the distribution of ancestral and joint family properties. This initiative is part of a broader move to modernize and formalize family property transactions that have traditionally been conducted through informal or undocumented means. The new format is designed to bring uniformity in the documentation of partition decisions and to minimize disputes arising from vague or incomplete agreements.

Under the revised framework, the partition agreement must clearly identify the HUF by name, mention the date of formation, and list the names and relationships of all coparceners and members involved. It must detail each asset subject to division, including immovable properties, bank accounts, investments, and other movable assets, along with the corresponding value and method of distribution. The agreement must also state whether the partition is total, covering all assets and members, or partial, involving specific properties or selected coparceners.

The new format mandates that the agreement be executed on stamp paper of appropriate value as per state laws and be signed by all adult coparceners. In the case of minors, their shares must be represented by a legal guardian and specifically documented in the agreement. The agreement must also be attested by at least two independent witnesses, and it is strongly recommended to register the document with the local sub-registrar to give it legal validity and ensure it is admissible in court if needed.

A crucial element in the new format is the inclusion of a declaration clause where all parties acknowledge that the partition has been carried out voluntarily and that each member has received their rightful share. This clause is intended to prevent future legal challenges based on allegations of coercion, misrepresentation, or concealment of facts. Additionally, a clause for resolving future disputes through mediation or arbitration may be included, offering an alternative dispute resolution mechanism that is less adversarial than traditional court proceedings.

To ensure transparency and ease of verification, the format also provides annexures for attaching supporting documents such as property title deeds, valuation certificates, identity proofs of members, and maps or layouts of land parcels. These annexures serve to confirm the authenticity of the assets being divided and the accuracy of the share allocation, thereby safeguarding the rights of all parties involved. The inclusion of detailed annexures also aids revenue and registration authorities in updating records post-partition without delay or confusion.

This new partition agreement format represents a significant legal and administrative advancement in how HUF property matters are handled.
