Definition and ownership

• Individual property refers to assets solely owned and controlled by one person
• It is not part of the joint family or HUF property
• The owner has full legal rights to use, sell, gift, or transfer it independently
• It is earned, inherited, or received in a personal capacity, not through HUF
• No other family member has a claim or right over it unless stated by law or will

Sources of individual property

• Assets acquired through personal income such as salary, profession, or business
• Property received as a gift or inheritance in personal name, not as a coparcener
• Assets purchased or developed using the individual’s own funds
• Any property acquired before the formation of HUF is treated as individual property
• Income generated from such property remains the sole income of the owner

Legal and tax status

• Individual property is taxed in the hands of the person who owns it
• It is not included in the income or assets of the HUF
• Owner can claim personal deductions and exemptions on this income
• Gifts received under specified limits are exempt as individual property
• Separate PAN and tax filing are applicable for income from such property

Transfer and succession

• The owner can transfer individual property through sale, gift, or will
• In case of death, succession is as per personal law applicable to the individual
• Legal heirs receive the property only if no contrary will exists
• The property does not automatically become part of HUF unless contributed
• Transfer to HUF must be voluntary and properly documented

Difference from joint family property

• Individual property belongs to one person; joint property is shared by the family
• HUF property is managed by the Karta, but individual property is self-managed
• Rights in joint property arise by birth, not so in individual property
• Individual property can be freely disposed of without family consent
• Joint family property becomes individual only after a partition or legal transfer
