What happens to TAN after business closure?
TAN Remains Active Unless Formally Surrendered
- After business closure, the TAN does not automatically expire or get cancelled.
- It remains valid and active in government records until the holder formally submits a surrender request to the Income Tax Department.
- Failure to surrender TAN can lead to unnecessary notices or compliance expectations, even after operations have ceased.
Surrender of TAN is Mandatory
- The business must submit a written application for TAN surrender, explaining the reason (i.e., closure of business).
- This includes providing:
- A copy of the TAN allotment letter
- Proof of business closure (such as deregistration, dissolution documents, or final tax filings)
- PAN and identity proof of the authorized signatory
Filing Final TDS Returns
- Before surrendering TAN, the entity must:
- Clear all outstanding TDS liabilities
- File any pending TDS returns or correction statements
- Issue final TDS certificates to deductees (if applicable)
- This ensures complete and clean closure in the TDS compliance system.
Preventing Future Compliance Burdens
- By surrendering TAN, the entity avoids:
- Receiving system-generated reminders or default notices
- Being assigned compliance ratings or audits under a now-defunct business
- Unwarranted demands or obligations in future tax years
Final Confirmation from Department
- Once the TAN is surrendered and processed, the Income Tax Department formally deactivates the TAN.
- It is advisable to retain the acknowledgment of surrender for records, in case of future verification or audits.
