Government Clarifies Rules on Professional Tax for Freelancers
The government has officially clarified that freelancers are liable to pay professional tax under existing state laws, provided they meet the prescribed income thresholds. This clarification follows growing ambiguity regarding the inclusion of gig workers, consultants, and other self-employed individuals in the tax net. Authorities emphasized that professional tax is not limited to salaried employees but extends to all individuals earning income through any profession, trade, or calling in states where the tax is applicable.
According to the circular issued by relevant state departments, freelancers must obtain a Professional Tax Enrolment Certificate (PTEC) and make payments annually or as per the respective state’s schedule. The notification clearly states that failure to register or pay can attract penalties and interest, irrespective of whether the freelancer operates under a formal business name. State governments have been instructed to streamline the registration process to encourage compliance and avoid undue hardship to small service providers.
Officials also reiterated that exemptions and thresholds will continue to apply uniformly. Freelancers earning below the state-specific minimum income limit will not be required to pay, but those exceeding the limit must comply. The government also urged freelance professionals to maintain proper documentation of earnings and ensure timely payments to avoid legal complications. Enforcement measures are expected to intensify, especially in urban areas where the freelance economy is significantly growing.
