Standard Renewal Period
- A registered design is initially valid for ten years from the filing date.
- It can be renewed once for an additional period of five years.
- The renewal must be applied before the expiry of the initial ten-year term.
- Failure to renew on time results in the lapse of registration.
- No renewal is allowed beyond the maximum fifteen-year period.
Applicable Renewal Fees
- The renewal fee for natural persons is ₹2,000.
- The fee for small entities and startups is ₹4,000.
- Other legal entities must pay ₹8,000 for renewal.
- The fee is paid through Form-3 under the Designs Rules, 2001.
- Fees must be paid before the expiration of the initial registration term.
Mode of Payment
- Fees can be paid online through the IP India portal.
- Payment methods include internet banking, credit card, or government treasury challan.
- Physical applications must attach proof of demand draft or banker’s cheque.
- Receipts should be retained for confirmation and recordkeeping.
- Incorrect or incomplete fee payments may result in application rejection.
Consequences of Non-Payment
- If the renewal fee is not paid on time, the design registration lapses.
- The design enters the public domain and is no longer protected.
- The rights holder loses exclusive rights and enforcement remedies.
- Lapsed designs cannot be restored or re-registered under the same application.
- A fresh application must be filed to protect a similar design.
Legal and Procedural Guidelines
- The renewal provisions are specified in Section 11 of the Designs Act, 2000.
- All procedures must comply with the Designs Rules, 2001.
- The renewal request must include the registration number and applicant details.
- IP India publishes renewal status updates in the Designs Journal.
- The Register of Designs is updated upon approval of renewal.
