Meaning of Trademark Examination

  • Trademark examination is a formal process conducted by the Trade Marks Registry in India after an application is filed.
  • It involves reviewing the application to determine whether the mark complies with the provisions of the Trade Marks Act, 1999.
  • The goal is to assess if the trademark is eligible for registration based on legal and procedural standards.
  • Examination is a mandatory step before publication in the Trademark Journal.

Stages in the Examination Process

  • The application is assigned to an Examiner of Trademarks.
  • The examiner checks for completeness of application and proper classification.
  • It is then reviewed for both absolute grounds (like distinctiveness) and relative grounds (conflict with existing marks).
  • An Examination Report is issued outlining objections, if any.

Types of Objections

  • Objections under absolute grounds (Section 9) relate to descriptiveness, lack of distinctiveness, or being generic.
  • Objections under relative grounds (Section 11) concern similarity or identity with existing trademarks.
  • Procedural objections may also arise, such as incorrect classification or incomplete information.
  • Objections do not mean rejection but require a response to clarify or amend the application.

Response to Examination Report

  • The applicant must file a written response (reply) within one month of receiving the Examination Report.
  • Supporting documents, legal reasoning, and evidence may be submitted.
  • If the examiner is satisfied, the trademark is accepted for publication in the journal.
  • If not, a hearing may be scheduled for further clarification.

Consequences of Examination Outcome

  • If accepted, the trademark proceeds to publication and the opposition period begins.
  • If refused after reply or hearing, the applicant may file an appeal before the Intellectual Property Appellate Board.
  • Timely and proper response can avoid delays and improve the chances of registration.
  • The examination ensures that only legally valid and non-conflicting marks are granted protection.
