Briefly explain TDS applicability on rent

Introduction

Tax Deducted at Source (TDS) on rent is a key provision under the Indian Income Tax Act, 1961, intended to ensure timely tax collection from rental income earners. Section 194-I of the Act lays out the rules under which individuals, companies, and other entities making rental payments must deduct tax before making payments to the landlord. TDS on rent applies to a broad category of properties including land, buildings, and machinery. This mechanism ensures tax compliance, transparency, and a consistent inflow of revenue to the government.

Legal Provision under Section 194-I

Section 194-I of the Income Tax Act, 1961, specifies that any person other than an individual or Hindu Undivided Family (HUF), who is responsible for paying rent exceeding the specified threshold, must deduct tax at the time of credit or payment, whichever is earlier. For individuals and HUFs subject to tax audit under Section 44AB, this provision also becomes applicable. Rent is broadly defined to include payments for land, buildings, plant, machinery, equipment, furniture, and fittings, whether owned or leased by the payee.

Threshold Limit for TDS Applicability

TDS on rent becomes applicable only if the total amount of rent paid or credited during the financial year exceeds two lakh forty thousand rupees. This threshold applies per payee, not per property, and once the limit is crossed, TDS must be deducted on the entire amount. Rent paid below the threshold does not attract TDS under Section 194-I. Companies must monitor cumulative payments to ensure compliance.

Applicable TDS Rates

The rate of TDS depends on the nature of the rented asset. For rent paid for the use of land or buildings, the applicable TDS rate is ten percent. For rent paid for the use of plant, machinery, or equipment, the rate is two percent. If the landlord fails to provide a valid PAN, the payer is obligated to deduct tax at a higher rate of twenty percent. The payer must deposit the deducted tax with the government and issue a TDS certificate in Form 16A.

Timing of Deduction and Deposit

TDS must be deducted at the time of credit of rent to the landlord’s account or at the time of actual payment, whichever is earlier. Once deducted, the tax must be deposited with the central government by the seventh of the following month. Timely deduction and deposit are necessary to avoid interest and penalties under Section 201 and Section 234E of the Income Tax Act.

TDS Return Filing and Certificate Issuance

Companies are required to file quarterly TDS returns using Form 26Q, disclosing the rent paid, amount deducted, and PAN of the deductee. The TDS certificate in Form 16A must be issued to the landlord within fifteen days from the due date of filing the return. These steps are crucial for the landlord to claim credit for the TDS in their income tax return.

Exceptions and Exemptions

No TDS is required if the payee is a government entity, statutory authority exempt under the Act, or if a lower deduction certificate is furnished under Section 197. Further, TDS on rent paid to Real Estate Investment Trusts (REITs) for specified assets may be exempt under certain conditions. Rent paid by individuals or HUFs not subject to tax audit is also exempt unless Section 194-IB applies.
