Can packaging designs be registered?

Eligibility for Registration

  • The design must be capable of being produced by an industrial process.

  • Unique bottle shapes, container forms, box designs, and cap structures.
  • Artistic patterns or decorations applied to wrappers and cartons.
  • Distinctive lid or closure configurations with visual appeal.
  • Decorative packaging for food, cosmetics, electronics, and luxury goods.
  • The design must reflect visual appeal and not be purely structural.

Filing Requirements

  • The application must include clear representations of the packaging design.
  • All views of the design—front, side, top, and perspective—must be submitted.
  • The class and subclass must be selected according to the Locarno Classification.
  • A statement of novelty must describe the visual features being claimed.
  • The packaging must be identified by its intended article or product type.

Legal Protection and Benefits

  • The registered design protects against unauthorized imitation or copying.
  • The owner can enforce rights through civil remedies and legal proceedings.
  • The design is protected for ten years, renewable for five additional years.
