Describe the employer’s obligations under EPF

Introduction

Under the Employees’ Provident Fund and Miscellaneous Provisions Act, 1952, employers play a central role in ensuring the successful implementation of the EPF (Employees’ Provident Fund) scheme. Breakup of Employer’s Contribution
Out of the employer’s 12% contribution:

  • 8.33% goes to the Employees’ Pension Scheme (EPS)
  • 3.67% goes to the Employees’ Provident Fund (EPF)
    Additionally, the employer must pay administrative charges (currently 0.50% of wages) and EDLI (Employees’ Deposit Linked Insurance) contributions.

Filing Electronic Challan-cum-Return (ECR)
Employers must file the Electronic Challan-cum-Return (ECR) monthly on the EPFO portal. This includes details of employee wages, UANs, contributions, and compliance. Filing ECR is essential for proper credit of contributions to employee accounts.

KYC Compliance
Employers are responsible for uploading and verifying KYC documents such as Aadhaar, PAN, and bank account details of their employees on the EPFO portal. This ensures that employees can avail of online services, withdrawals, and transfers smoothly.

Transfer and Exit Formalities
Upon an employee’s resignation or termination, the employer must mark the exit date on the EPFO portal. For job changes, they should assist in linking the new Member ID with the existing UAN. This ensures continuity of EPF contributions and benefits.

Record Maintenance and Inspections
Employers must maintain all EPF-related records, including salary registers, contribution sheets, and employee declarations. These records must be made available during EPFO inspections or audits to verify compliance.

Responding to Employee Claims and Grievances
Employers are expected to assist employees in filing claims for withdrawals, advances, pension, or insurance. They must also respond to EPFO notices and resolve any disputes or complaints filed by employees in relation to EPF matters.

Adherence to Amendments and Notifications
Employers are legally required to stay updated on amendments in EPF rules, contribution rates, or procedures as notified by the EPFO. Failure to comply can result in penalties, interest on delayed payments, or legal action.
