Describe the process to surrender voluntarily

Introduction

The Goods and Services Tax (GST) law provides for the voluntary surrender of registration by a registered taxpayer who is no longer required to be registered under the Act. Businesses may decide to close their operations, transfer ownership, reduce their turnover below the threshold limit, or change their business structure. In such cases, they may initiate the cancellation of their GST registration on their own. This process is referred to as voluntary surrender or voluntary cancellation. The GST law outlines a defined procedure to complete this process, which ensures that all tax obligations are discharged and the registration is closed formally.

Eligibility for Voluntary Surrender

Any person who has been granted GST registration and is no longer liable to be registered under the GST Act can apply for voluntary cancellation. This includes individuals whose aggregate turnover has fallen below the threshold limit, those who have ceased business operations, or those who have changed their business constitution. The option to surrender is also available to voluntarily registered persons who no longer wish to remain registered.

Filing Application in Form GST REG-16

The process of voluntary surrender begins with the submission of Form GST REG-16 on the GST portal. This form must be filed by the registered person or their authorized signatory. The applicant is required to provide the reason for cancellation, the date from which the cancellation is sought, and relevant details such as stock held, liability on inputs and capital goods, and payment of outstanding dues. The form also requires the applicant to declare whether they have any pending tax liabilities.

Declaration of Stock and Liabilities

A crucial part of the surrender application is the declaration of inputs, semi-finished goods, finished goods, and capital goods held on the date of cancellation. The taxpayer must reverse the input tax credit availed on such stock or pay tax on the same. This ensures that no undue credit benefit is retained after exiting the GST system. Any balance in the electronic credit ledger must also be reversed at the time of cancellation.

Payment of Outstanding Dues

Before applying for cancellation, the taxpayer must clear all outstanding dues, including tax liabilities, interest, and late fees. Any unpaid dues must be paid using Form DRC-03. The cancellation application cannot proceed unless all pending obligations are fulfilled. The payment details must be correctly reflected in the application and supported by relevant documentation.

Verification and Acknowledgment

After submitting the application, the GST portal generates an acknowledgment for future reference. The application is then forwarded to the jurisdictional tax officer for verification. The officer examines the reasons, ensures all returns are filed, liabilities are discharged, and stock declarations are accurate. If satisfied, the officer issues a cancellation order in Form GST REG-19 within thirty days of receiving the application.

Issuance of Cancellation Order

The cancellation order issued by the officer officially terminates the GST registration from the date specified in the order or the date requested by the taxpayer, whichever is later. The order includes details of liabilities, instructions for final return filing, and any further action required. Once the order is issued, the taxpayer ceases to be a registered person and is no longer required to file regular returns.

Filing of Final Return in Form GSTR-10

After the cancellation order is issued, the taxpayer is required to file a final return in Form GSTR-10 within three months. This return includes details of inputs and capital goods held, tax payable, and liability adjustments. Filing this return marks the completion of the exit process under GST. Non-filing of the final return attracts penalties and legal consequences.

Conclusion

Voluntary surrender of GST registration is a structured and well-defined process that allows businesses to formally exit the GST system when they are no longer liable to be registered. It involves filing the prescribed application, declaring liabilities, paying dues, and obtaining approval from the tax officer. Proper documentation, timely compliance, and adherence to legal procedures are essential to ensure a smooth and complete cancellation. Following this process not only maintains legal compliance but also protects the business from future liabilities or complications.
