Government Launches Awareness Drive on Section 8 Compliance
In a proactive move to bolster regulatory compliance among non-profit organizations, the Government of India has launched a nationwide awareness campaign focusing on Section 8 companies. Spearheaded by the Ministry of Corporate Affairs (MCA), the initiative aims to educate directors, promoters, and stakeholders of charitable entities about their statutory obligations under the Companies Act, 2013.
The awareness drive comes in response to rising instances of non-compliance, including delayed filings, inadequate disclosures, and governance lapses by Section 8 companies. Through this campaign, the government seeks to ensure that non-profit entities maintain financial discipline, file annual returns on time, and uphold transparency in their operations.
The campaign will feature webinars, regional workshops, digital toolkits, and expert panel sessions tailored to guide Section 8 companies on key topics such as timely submission of Form MGT-7 and AOC-4, maintenance of statutory records, adherence to board meeting norms, and eligibility for income tax exemptions. Special focus will also be placed on compliance with CSR fund utilization rules and the updated requirements for digital documentation.
Officials have stated that the drive is not aimed at penalizing small or emerging organizations but at building a culture of voluntary compliance and capacity building. By spreading awareness and offering resources for proper governance, the government aims to prevent inadvertent defaults and empower Section 8 entities to operate more effectively and ethically.
The MCA has also urged professional bodies like the Institute of Company Secretaries of India (ICSI) and ICAI to assist in this outreach by engaging their members in training and advisory roles. This nationwide effort marks a crucial step toward strengthening India’s non-profit ecosystem by reinforcing accountability, promoting best practices, and encouraging sustainable development through lawful and transparent operations.
