1. Approach the Nidhi Company’s Internal Grievance Cell
- The first step is to contact the Grievance Officer or the Managing Committee of the Nidhi Company
- Submit a written complaint via letter, email, or official grievance form
- Mention the membership number, nature of complaint, supporting documents, and desired resolution
- Request a written acknowledgment and keep a copy of the submitted complaint for the record
- The company is expected to resolve the grievance within a reasonable timeframe, usually 15–30 days
2. File a Complaint with the Registrar of Companies (ROC)
- If no satisfactory response is received, the complainant may escalate the issue to the Registrar of Companies (ROC) under the Ministry of Corporate Affairs
- The complaint can be filed online through the MCA21 portal
- Use the MCA Grievance Module and select the option to file a complaint against a company
- Provide details such as the CIN of the Nidhi Company, the complainant’s identity, description of grievance, and the evidence
- The ROC may initiate inspection, issue show-cause notices, or seek clarification from the company
3. Raise a Complaint through the Ministry of Corporate Affairs (MCA) Helpdesk
- You can also file complaints directly through the MCA Public Grievance Redressal System
- Visit the PG Portal and register your grievance under the “Ministry of Corporate Affairs”
- Attach any correspondence, receipts, or documents related to your membership, deposits, or loans
- The grievance will be forwarded to the appropriate authority and tracked using a unique grievance ID
- Updates and responses can be monitored online by the complainant
4. Legal Remedies through Consumer Forum or Civil Court
- If the grievance involves financial loss, breach of agreement, or negligence, the member can approach the Consumer Forum
- File a complaint under the Consumer Protection Act for a deficiency in service or unfair trade practices
- Alternatively, if a legal violation or breach of contract is involved, a civil suit can be filed in the appropriate court
- It is advisable to issue a legal notice before initiating formal proceedings
- Legal action may include claims for compensation, refund, or specific performance
5. Reporting Financial Fraud or Serious Misconduct
- If the issue involves fraud, misappropriation, or regulatory violations, a formal complaint can be submitted to
– Serious Fraud Investigation Office (SFIO)
– Economic Offences Wing (EOW)
– Local police or cybercrime cell, depending on the nature of the misconduct - These agencies may conduct inquiries and prosecute individuals responsible for criminal violations
- The complaint should include complete documentation, identity verification, and a written explanation of the fraud
- Parallel reporting to the MCA and ROC is also advised to ensure regulatory tracking
