Determining the Nature of the Company
Tax calculation begins by identifying the type of company. The classification affects applicable tax rates, exemptions, and deductions allowed under the Income Tax Act.
- Companies are categorized as domestic or foreign
- Domestic companies include Indian-registered entities
- Foreign companies have control and management outside India
- Tax rates and provisions differ based on company status
Computing Total Income of the Company
The total income is calculated by aggregating all sources of earnings. This includes business profits, capital gains, and other taxable receipts within the financial year.
- Business income after allowable expenses is the main component
- Capital gains from asset sales are included in total income
- Rental, interest, and other income sources are also taxable
- Exemptions and deductions are removed before final computation
Applying the Prescribed Tax Rate
Different tax rates apply based on turnover, type of company, and tax scheme adopted. The Finance Act each year defines the applicable corporate tax rates.
- Standard rate for domestic companies is thirty percent
- Companies opting under concessional schemes may pay twenty two percent
- New manufacturing units may be eligible for fifteen percent rate
- Foreign companies are generally taxed at forty percent
Adding Surcharge and Cess Components
Once basic tax is calculated, applicable surcharge and cess are added. These additional levies increase the effective tax liability of the company.
- Surcharge applies if income exceeds certain thresholds
- Health and education cess is four percent of tax plus surcharge
- Cess is uniformly applicable to all companies regardless of size
- Effective tax rate increases after surcharge and cess inclusion
Adjusting for Minimum Alternate Tax Provisions
If a company’s taxable income is low due to deductions, it may still need to pay Minimum Alternate Tax. MAT ensures that profit-making companies pay a minimum tax.
- MAT is levied on book profits reported in financial statements
- The current MAT rate is fifteen percent plus applicable surcharge and cess
- Companies under special tax regimes may be exempt from MAT
- MAT credit can be carried forward for up to fifteen assessment years
Considering Deductions and Exemptions Available
Companies can reduce taxable income by claiming eligible deductions. These are allowed under various sections of the Income Tax Act for specific activities or expenses.
- Deduction for scientific research and specified capital expenditure
- Incentives for units in special economic zones and infrastructure projects
- Losses and depreciation carried forward from earlier years are deductible
- Donations and CSR contributions may also be eligible for deduction
Filing Tax Returns and Final Assessment
The tax liability must be reported in the income tax return. After filing, the department may process the return, issue refunds, or initiate assessments if needed.
- Companies file their return using Form ITR-6
- Advance tax must be paid in four installments if liability exceeds limits
- Interest and penalties apply for delayed payment or incorrect filings
- Final liability is confirmed after processing by the tax department
