Hello Auditor

How long does the design registration process take?

Filing Stage

  • The design registration process begins with the submission of Form-1 and required documents.
  • The application can be filed online or physically at the Design Office.
  • Acknowledgment of the application is typically issued within one to three working days.
  • The filing date is recorded and used for determining priority and validity.
  • The application is assigned a registration number and application number immediately.

Examination Phase

  • The Design Office conducts formal and substantive examination of the application.
  • Examination includes checking novelty, originality, classification, and visual appeal.
  • If no objection is raised, the design proceeds to acceptance.
  • If objections are found, an examination report is issued within one to two months.
  • The applicant has six months (extendable by three more) to respond to objections.

Acceptance and Registration

  • If the application is in order or objections are resolved, the design is accepted.
  • Registration is granted, and a Certificate of Registration is issued by the Controller.
  • The registration is typically completed within six to eight months from the filing date.
  • The time may vary depending on workload, objections, or delays in response.
  • Straightforward applications with no objections may be registered sooner.

Publication in the Designs Journal

  • After registration, the design is published in the official Designs Journal.
  • Publication generally occurs within one to two months after registration.
  • This completes the registration cycle and provides public notice.
  • The design becomes enforceable from the date of registration.
  • Publication details include class, article, proprietor, and representations.

Total Timeframe Estimate

  • The complete process typically takes 6 to 12 months under normal conditions.
  • Delay may occur due to objection handling, document issues, or administrative backlog.
  • Early and accurate filing helps avoid unnecessary extensions.
  • Proactive responses to examination reports expedite the process.
  • The timeline may vary between individual applications.
