MCA Revises Checklist for Incorporation under Section 8
In a move aimed at simplifying and standardizing the incorporation process for non-profit organizations, the Ministry of Corporate Affairs (MCA) has issued a revised and comprehensive checklist for registering companies under Section 8 of the Companies Act, 2013. The updated checklist, now available through the MCA21 portal, is designed to help applicants avoid procedural lapses and ensure faster, error-free approvals.
The checklist provides a step-by-step breakdown of all mandatory documents, declarations, and procedural requirements needed for successful registration. It includes preparation of the Memorandum and Articles of Association, digital signatures for all directors, valid Director Identification Numbers (DINs), Form SPICe+ submission, and declarations of non-profit objectives.
New additions to the checklist also reflect recent policy updates such as the need for a minimum of two promoters, project-wise financial projections, and mandatory CSR registration numbers where applicable. The MCA has also emphasized proper drafting of the main objects clause, ensuring it falls strictly within the scope of charitable purposes defined under law.
Officials stated that the revision aims to reduce incorporation errors, limit application rejections, and improve transparency for both applicants and regulators. The checklist is especially helpful for first-time incorporators, legal consultants, and non-profit promoters seeking clarity on the latest compliance norms.
