What are the rules for international workers under EPF?

Definition of International Workers.

  • An International Worker is defined as a foreign national working in an establishment in India covered by the EPF Act.
  • It also includes Indian employees working in a foreign country with which India has a Social Security Agreement (SSA).
  • Both categories are brought under the EPF framework for contribution and benefit purposes.
  • The rule applies regardless of the employee’s nationality or salary structure.

Mandatory EPF Coverage.

  • Foreign nationals employed in Indian establishments must contribute to EPF unless specifically exempted.
  • There is no wage ceiling for international workers—contributions are on full salary.
  • Both employer and employee contribute 12% each on the employee’s total wages.
  • Employees from countries without SSA are compulsorily covered under EPF.

Exemptions through Social Security Agreements.

Benefits and Withdrawals.

  • International workers are entitled to full EPF benefits, including pension and insurance, if eligible.
  • EPF accumulations can be withdrawn on retirement, permanent return to home country, or under specified conditions.
  • Withdrawal is also allowed in case of completion of assignment or expiry of work visa.
  • Pension benefits under EPS may be subject to minimum service criteria, except for SSA-covered employees.
  • EDLI benefits are available to all covered international workers during their service in India.

Employer Compliance Responsibilities.

  • Employers must register international workers under EPF and assign UAN.
  • Contributions must be filed monthly with complete wage details.
  • Proper documentation, including passport and visa details, must be maintained.
  • SSA compliance must be ensured by collecting and verifying the CoC.

Non-compliance can lead to penalties, interest, and legal scrutiny under the EPF Act.
