Mandatory Forms and Application
- Duly filled Form-1 for design registration is required.
- The form must include applicant details, class of article, and title of design.
- The application must specify whether the applicant is an individual, startup, or legal entity.
- The prescribed fee must be paid at the time of filing the application.
- Each application must pertain to a single design and class.
Representation of the Design
- Clear drawings, photographs, or computer graphics showing the design from different views are required.
- The representations must be in duplicate and labeled correctly.
- The design must be shown on the actual article and not in isolation.
- The views should include front, back, top, bottom, left, right, and perspective.
- The images must clearly depict the aesthetic features being claimed.
Statement and Declaration
- A statement of novelty must describe the unique features of the design.
- The applicant must declare that the design is original and not previously published.
- A declaration of small entity or startup status, if applicable, must be provided.
- The class of article must be identified as per the Locarno Classification.
- The applicant must confirm that the design does not involve a functional aspect.
Supporting Legal Documents
- Power of Attorney is required if the application is filed through an agent.
- Proof of startup or small entity status must be submitted, if claimed.
- Priority documents must be included if the application claims priority from another country.
- Assignment deed is required if the applicant is not the original creator.
- Proof of identity and address of the applicant may also be required.
Submission and Format Compliance
- All documents must comply with the format prescribed under the Designs Rules, 2001.
- Physical submissions must be made in A4 size sheets with proper margins.
- Digital submissions must be uploaded through the official e-filing portal.
- All documents must be signed by the applicant or authorized agent.
- Incomplete or incorrect submissions may result in application objections or rejection.
