Proof of Death and Succession
- Death certificate of the original trademark owner issued by a competent authority.
- A succession certificate, legal heirship certificate, or probate of will as applicable under succession law.
- These documents establish the lawful transfer of rights to the legal heir.
- In case of multiple heirs, a No Objection Certificate (NOC) from other heirs may be required.
Ownership and Trademark Details
- A copy of the trademark registration certificate or application number of the trademark.
- Details of the trademark such as the class, description, and status.
- Original application documents may also be required for cross-verification by the Registrar.
Identity and Address Proof
- PAN card, Aadhaar card, or passport of the legal heir to establish identity.
- Recent utility bill or government-issued address proof confirming the heir’s residence.
- These documents are used to authenticate the individual claiming the proprietary rights.
Form and Authorization Documents
- Form TM-P for requesting the change of ownership due to transmission.
- Form TM-48, a Power of Attorney, if the legal heir is acting through a trademark agent or attorney.
- The forms must be correctly filled, signed, and submitted along with applicable fees.
Additional Supporting Documents
- A self-declaration or affidavit affirming the relationship with the deceased proprietor.
- A letter of request explaining the reason for change of ownership and listing all attached documents.
- Any court orders or settlement agreements in case of disputes among heirs or multiple claimants.
