What is the process for name reservation?

1. Importance of Name Reservation

  • Name reservation is the first formal step in registering a society, company, or firm.
  • It ensures that the proposed name is unique, lawful, and available for use.
  • It helps prevent confusion, duplication, and trademark conflicts.
  • A reserved name is protected from being used by others for a specific period.
  • It allows the applicant to proceed with drafting legal documents confidently.

2. Name Guidelines and Restrictions

  • The proposed name must not be identical or deceptively similar to an existing registered entity.
  • It should not contain offensive, misleading, or prohibited words under law.
  • For societies, the name must reflect the objectives and public benefit nature of the organization.
  • Use of words like “National,” “India,” “Council,” or “Federation” may require special approvals.
  • The name must comply with state or central guidelines, depending on where the society is registered.

3. Application Submission Process

  • The application for name reservation is typically submitted along with the registration documents to the Registrar of Societies.

  • The applicant must list two or three name options, in order of preference.
  • A covering letter stating the purpose of the society and the desired name is often required.
