Search and Application Filing
- Conduct a preliminary trademark search on the IP India website.
- Finalize the trademark class based on the goods/services offered.
- File the application using Form TM-A through the online portal or at the trademark office.
- Receive an acknowledgment and allotment number for future tracking.
Examination
- The Registrar examines the application for correctness and existing conflicts.
- An Examination Report is issued within 30 to 60 days of filing.
- If there are objections, a reply must be submitted within 30 days.
- A hearing may be scheduled if objections are not resolved through a written response.
Publication in Trademark Journal
- Once accepted, the trademark is published in the Trademark Journal.
- This publication allows the public to view and potentially oppose the application.
- The waiting period for opposition is four months from the date of publication.
Opposition (if any)
- Any person may file an opposition using Form TM-O within four months.
- The applicant must respond to the opposition within two months.
- Hearings may be conducted to resolve the opposition case.
- The Registrar decides whether to register or reject the trademark after reviewing the evidence.
Registration and Certificate Issuance
- If no opposition is filed, or the opposition is resolved in favor of the applicant, registration proceeds.
- A registration certificate is issued with the trademark number.
- The trademark is valid for ten years from the application date.
- Renewal is required every ten years to maintain legal protection.
